This Privacy Policy applies to your use of the YAYZTM digital gaming platform including the website www.yayz.com, any associated mobile application, and any other web age or application linking this this Privacy Policy (collectively, "Services") offered by Yayz Inc. ("Yayz," "we," "us," or "our"). This Privacy Policy describes the types of information that we may collect or you may provide when you use the Services, whether as a guest browsing the Services or registered user of the Services. This Privacy Policy also describes our practices for using, disclosing, and maintaining such information.
Your use of the Services, creating an account with us, downloading software from us, clicking to accept the terms of this Privacy Policy or otherwise manifesting assent to this Privacy Policy, or making a purchase or payment in connection with the Services constitutes your acceptance of this Privacy Policy. If you do not agree with this Privacy Policy, please immediately discontinue use of all of the Services.
Information We Collect.
"Personal information" is data that can be used to uniquely identify or contact a single person. We collected personal information two ways: (i) when you provide it to us, and (ii) automatically when you use the Services.
We collect your name (real name and registered user name on our platform), email address, age or birth date, telephone number, and physical location when you provide it to us in order to use the Services as a registered user. We may also request optional demographic data from time to time. Registered users are also required to create a secure password for their account. Our Services are directed to adults only and may not be legally available in all locations, so we are required to verify age and location to enjoy our games (provided our home page can be viewed on a guest basis for information without an account and without providing us with your name or contact details). Use our platform is subject to our separate Terms of Service for Yayz Users (including Social Casino and Sweepstakes Terms) ("Terms"). We need a valid email address for you to be able to offer you access to our platform. You may also optionally opt-in to receive text messages relating to your use of the platform by providing us with a mobile phone number you control opted into our texting program, but agreeing to receive texts is not required. Please see the separate terms for our texting program in the Terms. We treat mobile phone numbers provided to us for texting as personal information under this Privacy Policy.
If you are a developer or developer employee working on games for the Yayz platform, you are required to have a registered account like any other user, and we will also collect the name of your employer or organization, and its business address.
We operate a gaming platform. Accordingly, your gaming history, transactions, real and virtual currency balances, rewards, prizes and other gaming details are an important part of your user account details and when we link them to you as an identifiable individual in your account, we will treat them like your personal information.
When you use a "contact us" feature available via the Services, we will collect your name that you provide to us in order to respond to you together with email, phone number or account identifier you provide to us to respond to you depending on the type of support requested.
We use a third party service provider to help us verify age, currently Veriff, which has its own separate privacy policy. Veriff verifies age by comparing a selfie you take with acceptable forms of government-issued photo IDs, as notified to you during the age verification process. Veriff will let us know if you passed / did not pass its age verification and we retain a record of this for our compliance purposes. You are not able to use the Services as a registered user without engaging in the age verification process.
We do not collect your payment card or financial account information directly, but to make a purchase or payment to us online for purposes of enjoying the Services, or to transfer real currency from your Account to another account, you are required provide your personal information and payment card or account information to our third party payment processor(s), visible to you at the point of purchase or financial transactions.
If you seek to use another third-party service with links available in or from the Services not specifically described herein, as may be available from time to time, your use of their service is subject to their separate privacy policy posted on their separate website. We do not control third parties' privacy practices. We encourage you to review their separate privacy statements and terms.
We may offer the opportunity, for the convenience of our registered users, to log into their accounts with us using a "single sign on" type feature by using a third party platform (such as Google®, Facebook® or Skillz®) account to authenticate user name and password with Yayz for our Services. When you sign onto your Yayz account using another platform, you understand and agree that platform will know you are seeking to access a Yayz account and will authenticate you with your user name and password for that platform, and whatever sign-on requirements it uses (which we do not control), and send us a message once your authentication has occurred to permit you to access your Yayz account. We do not know your user name and password for third party platforms; we strongly encourage you to use strong and different passwords across all of your accounts.
Whenever you interact with our Services, we, as well as our service providers, may use assorted technologies that automatically or passively collect data about how the Services are being accessed and used, whether you access the Services as a guest or registered user. This data may include device type, browser type, unique number assigned to identify such device, operating system, application version, click path taken through the Services, your use of features or applications within the Services, other usage information and your general location ("Use Data"). This information helps us manage, improve and customize the Services' features and functionality and may be used to identify you like personal information.
For legal compliance purposes, we are also required to collect the specific location of registered users each time and during their use and access of the Services. This is done by a combination of the user providing location information and we and our service providers tracking the specific location of the device used to access the Services automatically. You may be required to disable VPN or similar services on your device that mask your location in order for our location verification to be able to proceed while you use the Services. When we associate your location with your personal information, we will treat it like personal information in accordance with this Privacy Policy.
How We Use Information We Collect.
We use information we collect, including your personal information and Use Data, to make the Services available, to provide products, services, features and functionality users have requested, communicate about them with users, and support, manage, troubleshoot, protect and improve the Services and our related offerings. We may also use your personal information to send you emails, text message if you are opted into text messages, and electronic messages to your account or through the Services. Receiving texts is optional. However, you are required to maintain a valid email address with us to be able to use the Services on a registered user basis.
We may use your information to make you aware of offers and opportunities of interest, other marketing and advertising, and to tailor in-game advertising to your preferences, or allow you to set your own preferences. If you see our ads outside the Services, they are subject to the advertising platform's separate terms for advertising (for example, if you see an ad for Yayz on Facebook, your ability to turn off the ad or select other ads you'd prefer to see is subject to Facebook's separate terms).
Information We Share with Others.
We may disclose your personal information to third parties, including to our affiliates and service providers, to provide you with what you request (e.g., delivery of products, services and information requested), to maintain, protect and enhance the security and integrity of the Services and our systems, to correct technical problems and errors, to technically process your information, to provide and improve the Services, to let you know about new features, functions and elements of the Services, for advertising and marketing, or to take precautions against liability. If you access Services via a mobile device, your request will be transmitted via your mobile carrier's or internet provider's network and your carrier/provider may have access to it. Consult your carrier's/provider's privacy policy for additional information.
We reserve the right to transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business.
We reserve the right to disclose any personal information as needed if that information is requested by law enforcement or regulatory agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity.
We also may disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, possible breaches of our terms and rules that apply to use of the Services, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us, and defend ourselves in the event of a legal proceeding.
Do-Not-Track Requests; Third-Party Tracking.
We are required to track the specific location of users/devices accessing the location-restricted Services we offer. We cannot opt you out from this tracking. If you are casually browsing our website for information as a guest, unless your browser settings are configured to make your online activities and publicly available information about your online activities (such as Use Data described above) invisible to usage analytics tools, we do not presently have the capability to omit you from usage analytics to the extent your browser sends us a "do not track" message. However, third parties, other than our vendors or affiliates assisting with making the Services available do not have authorization from us to track your uses or track what other activities you may have engaged in before or after using our Services (for example, using a different website). That said, we cannot control third-party tracking and there may be some third-party tracking that occurs without our knowledge or consent.
Third-Party Links.
As indicated above, we make links to third-party websites that are not controlled by us available to users within the Services for convenience. Please be aware that we are not responsible for the privacy practices or content of such third-party services. Consult their separate privacy policy in regard to their privacy practices.
Children.
Our Services are for adults and not intended for use by children. We do not knowingly collect personal information from children under 13. If we learn that we have collected the personal information of any such individual, we will take steps to delete the information as soon as possible.
Notice to Residents of Countries Outside the United States.
We are headquartered in the United States and currently our Services are only intended for individuals located in the United States. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States. We will protect the privacy and security of personal information according to this Privacy Policy regardless of where it is processed or stored.
Your California Privacy Rights.
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship what types of personal information, if any, the business shares with third parties for direct marketing purposes by such third parties and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. Changes to Privacy Policy.
We reserve the right to change or replace this Privacy Policy at our sole discretion at any time and we encourage you to review this Privacy Policy periodically. If we make material changes to this Privacy Policy, we will post the updated Privacy Policy on this page and via the Services. Any changes to the Privacy Policy will become effective upon posting of the revised policy. Your continued use of the Services following the posting of changes constitutes your agreement to such changes.
